Welcome to Liquid Art, an online marketplace where users can buy and sell collectibles. By using Liquid Art’s platform, you agree to be bound by these Terms & Conditions (“Terms”). Please read them carefully before using our services. These Terms apply to both buyers and sellers (collectively, “Users”) of the platform. If you do not agree to these Terms, you must not use the services.

1. Definitions

  • “Platform”: The Liquid Art website and mobile app, collectively referred to as “Liquid Art,” which provides a marketplace for buying and selling collectibles.

  • “Seller”: A registered user who lists items for sale on the Liquid Art platform.

  • “Buyer”: A registered user who purchases items through the Liquid Art platform.

  • “Items”: Collectibles listed for sale on the Liquid Art platform by a seller.

  • “Transaction”: The purchase and sale of an item between a buyer and a seller, facilitated through the Liquid Art platform.

2. General Terms for All Users

  • 2.1 Account Registration
    • To use Liquid Art’s marketplace, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
    • Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.
    2.2 Eligibility
    • Users must be at least 18 years old to create an account and participate in transactions on Liquid Art. By using the platform, you represent and warrant that you meet this age requirement.
    2.3 Prohibited Activities

    Users agree not to engage in any of the following prohibited activities:

    • Violating any applicable law, regulation, or third-party right.
    • Posting fraudulent, counterfeit, or illegal items for sale.
    • Using bots, scripts, or any other automated methods to interact with the platform.
    • Disrupting, manipulating, or hacking the platform to interfere with other users’ transactions.
    2.4 Fees
    • Liquid Art charges a 9.50% Platform Fees for certain activities on the platform, including transaction fees for both buyers and sellers. You are responsible for paying these fees as specified.

3. Terms for Sellers

  • 3.1 Listing Items
    • Sellers are responsible for providing accurate descriptions, images, and details for the items they list for sale on the platform. You represent that you own the item or have the necessary rights to sell it.

    • Sellers must ensure that their items comply with Liquid Art’s prohibited items policy, which includes, but is not limited to, illegal, fraudulent, or counterfeit items.

    • Liquid Art reserves the right to remove any listings that violate our policies or guidelines without notice.
    3.2 Pricing & Payment
    • Sellers are responsible for setting the price of the items they list for sale. Once a buyer completes a purchase, the seller will receive the agreed-upon price minus any applicable fees.

    • Payment for items sold on Liquid Art will be processed through the platform’s designated payment processor. Sellers must provide accurate banking or payment details to receive payments.
    3.3 Fulfillment & Shipping
    • Sellers are responsible for packing and shipping the item to the buyer once a transaction is confirmed. Shipping should be done in a timely manner and in compliance with any delivery timeframes specified during listing.

    • Sellers must provide a valid tracking number for shipped items to ensure proper delivery tracking.

    • In the event of a dispute regarding non-delivery or damage during transit, sellers may be required to provide evidence of shipment or refund the buyer.
    3.4 Refunds & Returns
    • Sellers must comply with Liquid Art’s return and refund policies. In general, sellers are required to accept returns and offer refunds if items are not as described or if there is an issue with the transaction that is determined to be the seller’s fault.

    • Buyers are required to initiate any refund or return requests through the platform, which will help resolve disputes in accordance with our policy.
    3.5 Seller Conduct
    • Sellers are expected to provide excellent customer service and maintain good communication with buyers. Sellers who repeatedly engage in fraudulent, misleading, or dishonest practices may have their accounts suspended or terminated.

4. Terms for Buyers

  • 4.1 Making a Purchase
    • Buyers can browse listings, select items, and proceed to checkout to purchase items from the marketplace.

    • By making a purchase, the buyer agrees to pay the listed price plus any applicable taxes, shipping, or handling fees.

    • All transactions are subject to the availability of the listed items and confirmation of payment.
    4.2 Payment
    • Liquid Art accepts payments through the platform’s designated payment processors. Payment must be made in full and in the currency specified at checkout.

    • Buyers authorise Liquid Art to process the payment for their transactions.
    4.3 Shipping & Delivery
    • Once a seller ships an item, buyers will be notified, and they should expect delivery within the timeframe specified by the seller or Liquid Art’s shipping policy.

    • Buyers are responsible for providing accurate delivery details and ensuring someone is available to receive the item upon delivery.
    4.4 Refunds & Returns
    • If a buyer receives an item that does not match the description or is defective, they should contact the seller directly or initiate a return request through the platform within 7 days of receiving the item.

    • Liquid Art’s return policy will govern whether a refund or exchange is provided.
    4.5 Buyer Conduct
    • Buyers are expected to interact respectfully with sellers, follow through with purchases once committed, and refrain from fraudulent or unethical behaviour, such as disputing legitimate transactions without cause.

5. Disputes and Resolution


5.1 Dispute Resolution
  • In the event of a dispute between a buyer and a seller, both parties agree to resolve the matter directly through Liquid Art’s messaging system. If the issue remains unresolved, Liquid Art may intervene and mediate the dispute.
5.2 Chargebacks and Payment Disputes
  • In the case of a chargeback or payment dispute initiated by a buyer or payment provider, Liquid Art reserves the right to suspend or terminate the buyer’s account and take appropriate actions to recover the funds. Sellers are not responsible for chargebacks resulting from fraudulent buyer activity.

6. Intellectual Property

  • Liquid Art and its users respect intellectual property rights. All content, including images, logos, and text, on the platform is protected by copyright, trademark, or other intellectual property laws.

  • Sellers retain ownership of the intellectual property rights to their listings, but by listing items on Liquid Art, sellers grant Liquid Art a non-exclusive, royalty-free license to use, display, and promote their listings.

7. Limitation of Liability

  • Liquid Art does not guarantee the accuracy, completeness, or legality of the listings or transactions on the platform. Users engage in transactions at their own risk.

  • To the fullest extent permitted by law, Liquid Art is not liable for any damages, losses, or harm arising out of the use of the platform, including issues related to payments, delivery, or disputes between buyers and sellers.

8. Termination & Suspension

  • Liquid Art reserves the right to suspend or terminate any user account if it violates these Terms or if the user engages in fraudulent or unlawful activities.

  • Either party may terminate their account at any time. Upon termination, users will remain liable for any outstanding transactions or obligations incurred before termination.

9. Changes to Terms & Conditions

  • Liquid Art reserves the right to modify these Terms at any time. Users will be notified of significant changes, and continued use of the platform constitutes acceptance of the updated Terms.

10. Governing Law

  • These Terms will be governed by and construed in accordance with the laws of Singapore. Any disputes related to these Terms will be resolved in the competent courts of Singapore.
